Martin Gillespie, a proud father of three and grandfather of eight, was pronounced dead shortly after arriving by ambulance at CHI Health-Missouri Valley on April 1, 2026. What should have been a time for grieving quickly turned into a nightmare for his daughters, Christina Gubbels and Daun Stoddard. According to a federal lawsuit filed in the U.S. District Court for the Southern District of Iowa, hospital staff allegedly bypassed the daughters entirely and relied on an aunt as the supposed legal decision-maker for anatomical gifts — despite having records showing Gillespie had living biological children.
The complaint paints a disturbing picture of haste and alleged negligence. Gillespie had never registered as an organ, tissue, or eye donor during his lifetime. Yet, just hours after his death, at around 4:50 a.m., the hospital made a routine referral to the Iowa Donor Network. Within a short time, his organs, skin, and eyes were removed. His body was then sent to a funeral home for cremation, leaving his daughters with no chance to say a proper goodbye or honor his remains as they wished.
Gubbels and Stoddard allege the hospital made “no attempt” to contact them, even though they lived in nearby Nebraska and were readily identifiable as next of kin. They claim the facility possessed clear information about the family structure but chose to proceed with an unauthorized relative. The daughters argue this was not just a simple error but demonstrated recklessness, fraud, and a blatant disregard for legal protocols governing consent in organ procurement.
For the family, the emotional toll has been devastating. Losing a parent is painful enough; discovering that his body was partially dismantled without permission has compounded their grief with anger, betrayal, and profound trauma. They describe feeling robbed of closure and violated on behalf of their father, a man who served his country honorably in the Air Force.
