Marvin Gabrion, the ruthless predator who raped 19-year-old Rachel Timmerman and later kidnapped and drowned her in a remote lake to dodge justice, had his federal death sentence commuted to life in prison by President Joe Biden last December – robbing a grieving family of final closure in a case that horrified the nation.
The saga of depravity began on August 6, 1996, when Timmerman, a single mother from a broken home determined to turn her life around for her infant daughter Shannon Verhage, joined a card game that turned into her worst nightmare. Lured into a vehicle by Gabrion – a 43-year-old family acquaintance with a violent rap sheet – and two others, Wayne Davis and Mikey Gabrion (Marvin’s nephew), the group headed out for beer. Gabrion allegedly forced the others out and savagely raped Timmerman, leaving her battered and bleeding.
Timmerman raced to her mother’s trailer the next morning, hysterical, nose lacerated, and reported the assault to Newaygo County deputies. Gabrion was arrested on a warrant but bonded out quickly. As the June 5, 1997, rape trial loomed, he unleashed hell to silence her.

The Abduction: A Date That Never Returned
On June 3 – two days before trial – Timmerman told her father she was stepping out for a “couple hours” with Shannon, then 11 months old. She vanished. Letters soon arrived in her handwriting, postmarked from Arkansas, claiming she’d fabricated the rape, married a man named “Delbert,” and was starting fresh with her baby. Prosecutors later proved Gabrion forced her to write them under duress.
Gabrion, the last to see her alive, fled. Witnesses placed him with accomplice John Weeks near Oxford Lake in Manistee National Forest – federal land – the day after. Campers ID’d them prepping cinder blocks stained with matching paint from Gabrion’s home.
A month later, on July 5, 1997, fishermen spotted a decayed body floating in the shallow, weedy lake: Timmerman, alive when dumped, hands cuffed behind her back, eyes and mouth duct-taped, chained to cinder blocks. She drowned in agony, fighting to the end. Keys matching the padlock turned up at Gabrion’s residence. No sign of baby Shannon – presumed murdered by Gabrion, who allegedly bragged in jail, “I killed the baby because there was nowhere else to put it.”
Gabrion’s Bloody Trail: Suspected Serial Killer
Apprehended in New York four months later using a stolen identity (Robert Allen, another missing man linked to him), Gabrion faced federal charges – Michigan banned the death penalty in 1846, but the lake’s location allowed prosecutors to seek execution. A landmark case: First federal death sentence in a non-capital state post-1988.
Evidence piled up: His nephew led cops to a campsite littered with duct tape. Gabrion handed a jailmate a map marked “body of 3, 1 found.” Wayne Davis’s body surfaced in nearby Twinwood Lake in 2002, killed similarly. John Weeks and Robert Allen vanished – Gabrion the last to see them. He collected Allen’s Social Security checks post-disappearance.
Trial of Horrors: Death for the Depraved
The 2002 Grand Rapids federal trial lasted weeks. Jurors heard Gabrion’s history: Abusive childhood, threats to shoot neighbors, beating a teen. Defense claimed brain damage; prosecutors painted a calculating killer. After 11 days, guilty. Two days later, death.
Appeals dragged decades – rejected in 2006, 2012, 2022. Gabrion, now 72, rots at Terre Haute.
Biden’s Controversial Mercy
On December 23, 2024, Biden commuted Gabrion’s sentence to life without parole – one of 37, sparing all but terror/mass murder cases. Rachel’s family erupted. Her father, Tim Timmerman: “I lost her. And worse yet, I lost my granddaughter.” Mother Lyn: Felt like a “lesser person.” They’d offered to drop death if Gabrion revealed Shannon’s grave – he refused.
